  1. About Us

    We are the GOLF UNION OF WALES LTD (company number 06027404), trading as Wales Golf, whose registered office is at Golf Union of Wales Ltd, Catsash Rd, Newport NP18 1JQ
     
  2. These Terms

    These terms and conditions apply when you join the Wales Golf Flexi Club.
     
  3. Wales Golf Flexi Club

    Flexi Club is a way for golfers who meet the eligibility requirements (set out in clause 5 below) to obtain an official World Handicap System (WHS) handicap index.
     
  4. Benefits of Flexi Club

    When you join Flexi Club you will be known as a member and you will be entitled to:
    • an official WHS handicap index, administered by the national Flexi Club Handicap Committee in accordance with the Rules of Handicapping as set out by the R&A
    • access to the App (although the Wales Golf App is free to download, only members of clubs affiliated to Wales Golf or Flexi Club members are given login details. Some “social” functions of the app require you to opt in and will be de-activated for those under 18)
    • offers and promotions from Wales Golf, affiliated clubs, and selected third parties with whom we may partner (if you choose to opt-in to email communications and are aged 18 or over). These benefits are subject to occasional change
    • support for membership, technical and handicap enquiries via FlexiClub@walesgolf.org
    • the benefit of Wales Golf policies and procedures put in place to protect the integrity of the sport and the handicap system. Further details can be found below
    • access to previous scoring data (for those members who have previously been a member of a golf club affiliated to Wales Golf, and subject to scoring data being available on the Wales Golf WHS Clubhouse platform)

    Flexi Club does not provide all of the same benefits as golf club membership. The following are rights that are not included in your Flexi Club membership:

    • you will not have playing rights over any golf course
    • you will not have the right to enter into club, county or Wales Golf competitions (competition entry remains at the discretion of the competition organiser)   
       
  5. Eligibility


    Flexi Club is open to all golfers (or aspiring golfers) who:

     

    • live in Wales
    • if under 18, have the permission of a parent or guardian to join Flexi Club
    • accurately provide all of the information requested during the registration process
    • do not already have a Flexi Club membership.
       
  6. Term


    Annual:

    You agree to join Flexi Club for a period of 12 months from the date upon which we confirm your membership and will be automatically renewed on a rolling basis unless you choose to cancel.  More information about auto-renewal can be found below.
     

    Monthly:

    You agree to join Flexi Club as a monthly paying member from the date upon which we confirm your membership and will continue indefinitely until cancelled. The recurring membership fee will be automatically deducted at the end of your membership period.   

     

  7. Cost


    Annual:

    It costs £55.00 per year to be an annual Flexi Club subscriber. We may increase this cost, but where we do so we will notify you in advance of your renewal date in line with the renewal process set out below.

     

    Monthly:

    It costs £5.50 per month to be a monthly Flexi Club subscriber. You can opt out at any time. We may increase this cost, but where we do so we will notify you in advance of your renewal date in line with the renewal process set out below.

    Payment can only be made by credit or debit card

     

  8. Registration Process & Payment


    Registrations must be completed online at www.walesgolf.org/wales-golf-flexi-club. We cannot accept any other method of registration for Flexi Club.

    The online form must be completed accurately and honestly, otherwise we reserve the right to cancel your membership. This includes the provisions relating to consent of a parent or guardian for subscribers aged under 18.

    The online form contains a link to the Wales Golf WHS Privacy Policy which sets out how we will process your personal data. You should read this document and let us know if you have any questions.

    You will be asked to enter payment details online. Your card payment details are sent to a third-party merchant services provider, Windcave. Details of how they process payment data can be found here https://sec.windcave.com/pxmi3/privacy-policy   

    Only one Flexi Club membership is allowed per person. If it appears to us that an individual has multiple memberships, relevant memberships will be cancelled at our discretion.

    During the online registration we will carry out eligibility checks. For example, if you have previously been a member of a golf club affiliated to Wales Golf, we will check on our system that your membership came to an end more than twelve months before your application.

    If our system shows that you are still an active member or your membership came to an end less than twelve months from your application date, you will need to provide us with evidence from your previous club to show that your membership came to an end more than twelve months ago. If you cannot provide us with that evidence, you will be able to become a Flexi Club subscriber once our system shows that twelve months has elapsed from the date of your resignation from your previous club. If required, we reserve the right to contact your previous club for any information relating to your previous membership.

    We may also check that you have not been subject to any suspension under the Wales Golf Safeguarding or Disciplinary Regulations.  

    We will send you an email to confirm your membership, and you are not a subscriber until we send you a confirmation email.

    Once you have received our confirmation email, you will be able to login to the Wales Golf Player Portal and the Wales Golf App.

     

  9. Your responsibilities


    Flexi Club is intended to be an inclusive scheme which opens up the benefits of the game of golf to as many people as possible. With the opportunity to play with an official WHS handicap index comes a number of responsibilities for the protection and benefit of golfers, golf clubs and the game.  We therefore require that as a subscriber you do the following:

    • Download the Wales Golf App on your device – without it you will be unable to get and maintain a handicap index
    • Keep your details up to date – if there are any changes to your contact details or payment details (for auto-renewal) you should change this via ‘My Profile’ on the Player Portal
    • Familiarise yourself with the code of conduct or other policies of any club at which you are playing, and make sure that you adhere to them
    • Familiarise yourself with WHS procedures relating to Flex Club which can be found here
    • Familiarise yourself with Wales Golf regulations or policies that apply to you (further details are set out below) and ensure that you follow them
    • Follow the Rules of Golf, follow golf etiquette and demonstrate fair play
    • Respect the rights of other players, golf course staff and officials
    • Take the safety of yourself and others into consideration
    • Follow any rules of the club you are visiting

     

    Safeguarding

    • Inform Wales Golf via safeguardingteam@walesgolf.org if you have any unspent convictions relating to sexual or violent offences – any information that you provide will be treated in confidence and
    • Inform Wales Golf via safeguardingteam@walesgolf.org if you have any concerns relating to the abuse of young people or vulnerable adults involved in golf. Safeguarding is the concern and responsibility of everyone and any information you provide will be treated in confidence

    This email inbox is only monitored by a limited number of staff in our safeguarding team and any information that is provided will be treated in confidence

    If you do not follow these requirements, we may apply a sanction which may include cancellation of your membership, or some other sanction permitted by our disciplinary or safeguarding regulations.
     

  10. Renewal Process


    We operate an auto-renewal process whereby payment is automatically taken from the billing card that you used for registration (or any updated card) at the end of your membership period.

    Annual:

    We will send you an email 11 months after your membership start date, and a further email one week prior to your membership renewal date, telling you of your renewal date, the cost to renew your membership and the process should you wish to cancel.

    If you do not cancel, the cost for a further 12-month membership period will be taken from your billing card using the details stored by our merchant services provider.  If we are unable to take payment from your billing card an email will be sent to notify you that your billing card has been declined.  The system will again try to take payment.

    If we have not received payment 14 days after renewal is due you will be automatically resigned from Flexi Club and you will no longer be able to access the Wales Golf Player Portal or Wales Golf app and any other Flexi Club Subscriber benefits will also lapse.  You will be unable to renew following this period, however you may apply to re-join the scheme at any time

    Monthly:

    Your Wales Golf Flexi Club Monthly membership will continue indefinitely until cancelled and the recurring membership fee will be automatically deducted at the end of your 1-month membership period.

    If you do not cancel, the cost for a further 1-month membership period will be taken from your billing card using the details stored by our merchant services provider.  If we are unable to take payment from your billing card an email will be sent to notify you that your billing card has been declined.  The system will again try to take payment.

    If we have not received payment 14 days after renewal is due you will be automatically resigned from Flexi Club and you will no longer be able to access the Wales Golf Player Portal or Wales Golf app and any other Flexi Club Subscriber benefits will also lapse.  You will be unable to renew following this period, however you may apply to re-join the scheme at any time.

     

  11. Cancellation and Cooling Off Period


    You can cancel your membership for any reason within 14 days of the date of your confirmation email upon joining and receive a full refund. We reserve the right to issue a partial refund dependent on your use of the service within the time period. To request a refund within this cooling off period you will need to email FlexiClub@walesgolf.org. If accepted, your access to the Wales Golf App and Player Portal will be terminated following your cancellation request.

    A Flexi Club membership can be cancelled at any time during the membership period.  To cancel a Flexi Club membership, when logged onto the Player Portal click on ‘My Account’ and click ‘Cancel Membership’. Once a request is made to cancel a Flexi Club membership, this will take effect on the anniversary of membership.  Upon this date you will be resigned from the system and access to the online web platform, Wales Golf app will terminate. Once resigned your WHS index will no longer be valid, and any other Flexi Club subscriber benefits will also lapse. No refund will be made in respect of the period between your cancellation request and the anniversary of your membership.

    If you join a golf club affiliated to Wales Golf during your membership period your Flexi Club membership will be superseded. Once we have confirmation from an affiliated club that you have become a member, your unique membership number, playing record and handicap index will be transferred and you will log in as a club member using the same details. Your opt-in preferences for email communications will be carried over. We will not be able to offer refunds in respect of any unused element of your Flexi Club membership.

    We reserve the right to cancel your membership at our discretion if we believe you have breached these terms, or if you have breached any regulations referred to below. If we exercise this right, we will let you know using the contact details you have provided to us.    

     

  12. Regulations and Policies


    As a Flexi Club subscriber the following regulations and policies will apply to you

    If we consider any subscriber is in breach of any of the above, we may take action.

     

  13. Our Responsibility to You


    If we breach these terms or are negligent, we may be liable to you for foreseeable loss or damage that you suffer. We are not liable for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.

    Nothing in these terms excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud, or fraudulent misrepresentation, or any other liability the law does not allow us to exclude or limit.

    We may update the Wales Golf App and Player Portal from time to time for reasons that include fixing bugs or enhancing functionality, which may mean that they are unavailable from time to time. We will try and keep any disruption to your access to a minimum.

    The Wales Golf App and Player portal rely on a number of things working properly to enable you to enjoy all of the features. Many of these, such as your internet connection and/or mobile signal, your location, your device and the app store, are entirely outside of our control. Although we will do everything we reasonably can to resolve issues, we are not responsible to you if you are unable to use any part of the app or online platform due to a poor connection or signal, fault in your device, app store failure or anything else it would not be reasonable to expect us to control.

     

  14. Other important information


    These terms are governed by the laws of England and Wales and any disputes will be subject to the exclusive jurisdiction of the English and Welsh courts.

    No one other than you or us has the right to enforce these terms and you are not allowed to transfer your rights under this agreement to anyone else.

    From time to time, we may review these terms and any regulations or polices that apply under them. We will inform you of any changes and unless you inform us via FlexiClub@walesgolf.org within seven days of us informing you, you will be deemed to have accepted such changes. If you do not accept any changes, we may need to, at our discretion, terminate your membership.
